Terms of Service

Introduction

These Terms of Service (the "Terms") set forth the terms and conditions for using ThumbnailThumb (the "App"). By downloading or using the App, you are deemed to have agreed to these Terms.

Article 1 (Definitions)

The terms used in these Terms are defined as follows:

  1. "App" means the ThumbnailThumb application and its related services.
  2. "User" means any person who uses the App.
  3. "Content" means images, text, and other data created by a User using the App.
  4. "Provided Assets" means image assets created by the Developer and provided through the App.

Article 2 (Grant of License)

By purchasing the App, you are granted a non-exclusive, non-transferable license to use the App. This license is limited to your own use of the App (including use for commercial production purposes) and does not permit sublicensing or transfer to third parties.

The following activities are prohibited:

Article 3 (User Content)

Copyright in Content (including thumbnail images) created by a User using the App belongs to the User. However, Users must comply with the following requirements:

Article 4 (Intellectual Property Rights)

All intellectual property rights in the App (including, but not limited to, copyrights, trademark rights, and patent rights) belong to the Developer or its licensors. These Terms do not transfer any such intellectual property rights to Users. However, use of Provided Assets is governed by the following Article.

Article 5 (Use of Provided Assets)

The Developer provides Provided Assets through the App. Provided Assets are created using generative AI.

Notwithstanding the preceding Article, the Developer permits Users who use the App in compliance with these Terms to make the following uses of Provided Assets:

This Article grants permission to use Provided Assets and does not transfer to Users any copyrights or other intellectual property rights in Provided Assets.

The Developer may change or discontinue the content or provision of Provided Assets without prior notice. Following any such change or discontinuation, the uses permitted under this Article will continue to apply to Provided Assets already incorporated into works. However, this does not apply where the Developer determines that a Provided Asset may infringe the rights of a third party and gives notice to that effect on this page or by other means.

Article 6 (Disclaimer)

The App is provided "as is." The Developer makes no warranties whatsoever regarding the following:

Notice: The Developer assumes no liability whatsoever for any direct, indirect, incidental, special, or consequential damages arising from use of the App.

Article 7 (Data Storage)

Project data created with the App is stored in the User's local storage. Users are responsible for backing up their data. The Developer assumes no liability whatsoever for any loss of data.

Article 8 (App Updates)

The Developer may provide updates to improve the App's features or fix bugs. Updates are provided at the Developer's discretion, and the Developer does not guarantee that updates will be provided on an ongoing basis.

Article 9 (Support)

Support for the App is provided at the Developer's discretion. The scope of support, response times, and supported languages may change without prior notice.

Article 10 (Changes to These Terms)

The Developer may change these Terms when the Developer deems it necessary. The revised Terms will take effect when posted on this page. Continued use of the App will be deemed acceptance of the revised Terms.

Article 11 (Governing Law and Jurisdiction)

These Terms are governed by and construed in accordance with the laws of Japan. The Tokyo District Court shall have exclusive jurisdiction as the court of first instance over any dispute relating to these Terms.

Article 12 (Severability)

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain valid and in full force and effect.

Article 13 (Apple App Store Terms)

Because the App is distributed through the Apple App Store, Users must also comply with Apple Inc.'s terms of service and license terms. If the Apple App Store terms conflict with these Terms, the Apple App Store terms will prevail.
